Sleep Rover Dog Boarding (“Sleep Rover,” “we,” “our,” or “us”) provides dog boarding services together with a website, online client portal, reservation system, communications, and related services (collectively, the “Services”).
These Terms of Service (“Terms”) govern your access to and use of the Services.
By creating an account, requesting or confirming a reservation, making a payment, signing a Sleep Rover boarding document, or otherwise using the Services, you acknowledge that you have read and agree to these Terms.
Our Privacy Policy is incorporated into these Terms by reference.
Individual boarding reservations may also be governed by a separate Boarding Policy, boarding agreement, authorization, waiver, or other document presented to you before a stay. Those documents are incorporated into your agreement with Sleep Rover. If a boarding-specific document conflicts with these Terms regarding the care of an animal, the boarding-specific document will control with respect to that issue.
Your Information
Sleep Rover collects and processes information necessary to provide our Services, including client information, dog profiles, vaccination records, boarding instructions, reservations, communications, and other information described in our Privacy Policy.
You are responsible for providing complete and accurate information and keeping information concerning you and your dog reasonably current.
Our Privacy Policy provides additional information regarding how information is collected, used, stored, and disclosed.
Eligibility and Client Accounts
You must be at least 18 years old and legally capable of entering into an agreement in order to create a Sleep Rover client account or make a reservation.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
You agree to notify Sleep Rover if you believe your account has been accessed without authorization.
Reservations and Availability
Submitting a reservation request does not guarantee availability.
Reservations are subject to available kennel capacity, completion of required forms, vaccination verification, payment of any required deposit, Sleep Rover’s acceptance of the dog for boarding, and any other requirements communicated during booking.
Sleep Rover may decline, modify, or cancel a reservation when reasonably necessary for operational, health, behavioral, or safety reasons.
Dogs from the same household may be permitted to share accommodations when appropriate. Sleep Rover retains the right to determine whether dogs can safely and appropriately share a kennel.
Rates, Deposits, and Payment
Current boarding rates, sibling rates, upgrades, and other available services are displayed or communicated during the booking process.
A 50% deposit is required at the time of booking unless Sleep Rover agrees otherwise.
Remaining balances and other charges are due according to the terms provided with your reservation.
You authorize Sleep Rover and its payment providers to process amounts you approve or otherwise owe under your confirmed reservation and applicable policies.
Sleep Rover may change its rates or available services in the future. Changes will not retroactively alter the agreed rate for an existing confirmed reservation unless you modify that reservation or agree otherwise.
Cancellations
Cancellations made with less than 48 hours’ notice are subject to a cancellation charge equal to two nights of boarding.
Cancellations made at least 48 hours in advance are not subject to this late-cancellation charge.
Any additional terms concerning deposits, refunds, credits, rescheduling, shortened stays, early pickup, or booking changes that are disclosed during the reservation process will also apply.
Vaccination Requirements
Dogs staying with Sleep Rover must meet our current vaccination requirements.
Sleep Rover presently requires proof of current:
Rabies vaccination.
DHPP vaccination.
Bordetella vaccination.
You are responsible for ensuring that vaccination records are complete, accurate, current, and provided before the reservation when requested.
Sleep Rover may refuse or cancel boarding when required vaccination documentation has not been provided or when a dog does not meet applicable health requirements.
Vaccination requirements may be updated when reasonably necessary for animal health, facility safety, veterinary guidance, or applicable law.
Health and Parasites
You agree to disclose relevant health conditions, illnesses, injuries, medications, allergies, dietary requirements, and other information reasonably necessary for Sleep Rover to care for your dog.
Flea and tick prevention is strongly recommended.
If fleas, ticks, or another apparent infestation are discovered during a stay, Sleep Rover may contact you regarding appropriate treatment or other measures necessary to protect your dog, other animals, and the facility.
You agree not to knowingly bring a dog to Sleep Rover that has a contagious illness or another condition that presents an unreasonable risk to other animals or people.
Behavior and Temperament
You must accurately disclose known behavioral concerns, including aggression, bite history, escape behavior, destructive behavior, severe anxiety, resource guarding, or other conduct that could reasonably affect the safety of your dog, other dogs, or people.
Sleep Rover does not impose a blanket breed restriction and may consider reactive dogs on a case-by-case basis.
A meet-and-greet or other evaluation may be required for dogs with a history of aggression, behavioral concerns, or prior dismissal from another boarding or daycare facility.
Sleep Rover reserves the right to refuse, discontinue, or modify services when we reasonably determine that a dog’s behavior presents an unacceptable safety risk.
Dogs requiring diapers are not accepted for boarding unless Sleep Rover expressly agrees otherwise.
Boarding Environment
Sleep Rover generally provides dogs with private kennel accommodations and access to private outdoor areas rather than requiring unfamiliar dogs to participate in group play.
Dogs may receive individual attention, outdoor access, playtime, and other services appropriate to their stay and selected boarding package.
While Sleep Rover takes reasonable measures to provide a clean, safe, and comfortable boarding environment, boarding an animal involves inherent risks that cannot be entirely eliminated.
Feeding, Medication, and Care Instructions
You are responsible for providing accurate instructions regarding your dog’s feeding schedule, dietary needs, medications, routines, and other care requirements.
Medication must be provided and identified in a manner that allows Sleep Rover to reasonably follow the instructions supplied by you or your veterinarian.
Sleep Rover personnel are not veterinarians and do not provide veterinary medical advice.
If a care instruction cannot reasonably or safely be followed, we may contact you to discuss an alternative.
Veterinary and Emergency Care
If Sleep Rover reasonably believes your dog requires veterinary or emergency attention, we will make reasonable efforts to contact you or your designated emergency contact.
Where circumstances permit, we will attempt to follow the veterinary and emergency-care instructions provided in your client profile or boarding documents.
Depending on the circumstances, your dog may be transported to your requested veterinarian or to the nearest reasonably appropriate veterinary or emergency facility.
If immediate action is reasonably necessary to protect your dog’s health or safety and you cannot be reached, you authorize Sleep Rover to obtain reasonable veterinary evaluation or treatment consistent with the emergency authorization contained in your boarding documents.
Unless otherwise agreed in writing or required by applicable law, you are responsible for veterinary expenses incurred on behalf of your dog.
Additional veterinary authorization and emergency-care provisions may be included in Sleep Rover’s Boarding Policy or boarding agreement.
Inherent Risks of Boarding
You understand that caring for and boarding animals involves risks that cannot be completely eliminated even when reasonable precautions are taken.
These risks may include illness, injury, stress, allergic reactions, unexpected behavioral changes, escape attempts, interactions with people or other animals, and exposure to contagious conditions.
Vaccination, sanitation, private accommodations, supervision, fencing, cleaning procedures, and other precautions can reduce risk but cannot guarantee that illness, injury, or other incidents will never occur.
Nothing in these Terms limits liability that cannot lawfully be limited or waived under applicable law.
Photos, Videos, and Client Updates
Sleep Rover may photograph or record your dog during a stay for purposes including client updates, care documentation, and internal records.
Providing photos or videos to you as part of your dog’s stay does not, by itself, grant Sleep Rover permission to use your dog’s image publicly for advertising or promotional purposes.
Public or promotional use may be governed by a separate consent or authorization.
Client Property
You are responsible for identifying any food, medication, bedding, toys, containers, leashes, collars, or other property provided with your dog.
Although Sleep Rover will take reasonable care of items left with a dog, ordinary pet activity may result in property becoming dirty, damaged, misplaced, or destroyed.
To the extent permitted by law, Sleep Rover is not responsible for ordinary damage to or loss of personal pet items unless caused by conduct for which liability cannot lawfully be limited.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Sleep Rover and its owners, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from:
Materially inaccurate or omitted information you provide concerning your dog.
Your violation of these Terms or an applicable boarding agreement.
Your dog’s behavior or actions where Sleep Rover was not legally responsible for the underlying conduct.
Your violation of another person’s rights or applicable law.
This provision does not require you to indemnify Sleep Rover for liability that cannot legally be transferred or waived.
Disclaimer of Warranties
The website, client portal, online booking system, and other electronic portions of the Services are provided on an “as available” basis.
Sleep Rover does not guarantee that its website, portal, communications systems, or other technology will operate without interruption, error, delay, or technical failure.
To the maximum extent permitted by law, Sleep Rover disclaims implied warranties relating to these electronic Services, including implied warranties of merchantability and fitness for a particular purpose.
Nothing in this section eliminates obligations concerning boarding services that cannot lawfully be disclaimed.
Limitation of Liability
To the maximum extent permitted by applicable law, Sleep Rover and its owners, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the website, client portal, booking system, or other Services.
Sleep Rover is not responsible for interruptions to online Services, temporary inability to access an account, or loss caused solely by systems or providers outside Sleep Rover’s reasonable control.
Any limitation of liability contained in a separately signed Boarding Policy or boarding agreement will also apply according to its terms.
Nothing in these Terms excludes or limits liability to the extent such liability cannot legally be excluded or limited.
Suspension, Refusal, and Termination of Services
Sleep Rover may restrict or terminate access to the Services, decline future reservations, cancel an account, or refuse to accept a dog when reasonably necessary because of:
Safety concerns.
Aggressive or dangerous behavior.
Materially inaccurate information.
Failure to satisfy vaccination or health requirements.
Failure to pay amounts owed.
Abuse, harassment, or threats toward Sleep Rover personnel or others.
Fraud or misuse of the Services.
Repeated violations of Sleep Rover policies.
Other circumstances making continued service unsafe, unlawful, or unreasonable.
Where appropriate and reasonably possible, Sleep Rover will communicate with the client regarding the issue.
Intellectual Property
The Sleep Rover name, branding, website, software, text, graphics, photographs owned by Sleep Rover, and other original materials provided through the Services may be protected by copyright, trademark, and other intellectual-property laws.
Except where expressly permitted, you may not copy, reproduce, distribute, modify, sell, or commercially exploit Sleep Rover’s protected materials without authorization.
You retain ownership of materials you provide to Sleep Rover, subject to the permissions reasonably necessary for us to process those materials and provide the Services.
Acceptable Use
When using Sleep Rover’s website, portal, or other electronic Services, you agree that you will not:
Provide knowingly false or misleading information.
Attempt to access another client’s account or information.
Interfere with the security or operation of the Services.
Upload malicious code, viruses, or harmful material.
Use automated systems in a manner that disrupts the Services.
Upload material that infringes another person’s intellectual-property or privacy rights.
Use the Services for fraud or other unlawful activity.
Harass, threaten, or abuse Sleep Rover personnel or other users.
Sleep Rover may remove content or restrict accounts that violate these requirements.
Future Amendments
We may update these Terms from time to time to reflect changes to our Services, business practices, policies, or applicable law.
Updated Terms will be posted with a revised “Last updated” date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
Material changes affecting an already-confirmed reservation will not retroactively change the agreed terms of that reservation unless required by law or agreed by the parties.
Governing Law
These Terms and any claim arising from or relating to them or the Services will be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Dispute Resolution
Before escalating a dispute, you and Sleep Rover agree to make a good-faith effort to resolve the matter directly.
A written notice of dispute should describe the issue, include reasonably relevant information, and explain the resolution being requested.
If the dispute cannot be resolved directly, the parties agree to attempt mediation before initiating litigation, except where emergency injunctive relief or another remedy is permitted by applicable law.
Except for disputes involving intellectual-property rights or claims that qualify for small claims court, and to the extent permitted by applicable law, disputes that remain unresolved after the required good-faith resolution and mediation process will be resolved through binding arbitration administered by the American Arbitration Association under its applicable rules.
A qualifying claim may instead be brought in small claims court.
For any dispute that is not subject to arbitration or small claims court, the parties consent to exclusive jurisdiction and venue in the appropriate state courts located in Cherokee County, Georgia, or the applicable United States District Court for the Northern District of Georgia.
To the extent permitted by law, YOU AND SLEEP ROVER WAIVE THE RIGHT TO A TRIAL BY JURY FOR CLAIMS SUBJECT TO THIS PROVISION.
